Removing X Spouse From Mortgage Loan

By Brad Lynch on November 7, 2016 1 Comment

Are you trying to research and understand your options for removing you ex-spouse or spouse that is soon to be the ex-spouse from your mortgage loan, or you would like to be removed from the current mortgage to be able to qualify for your own mortgage after your divorce?  I have heard it all.  If you have a question that has anything to do with divorce and your mortgage, I have had the phone call and answered that question.  There is really only one way to be taken off a mortgage…not to be mistaken with taken off the title of a home.

divorce-picHow to remove spouse from my home loan?

Simple!  Whether you are keeping the home, or your spouse is keeping the home after the divorce, whomever is keeping the home needs to refinance AFTER the divorce is final, and as part of the process you will submit your divorce decree to your new lender (us) and we will not list the leaving spouse on title and we will not list leaving spouse on your new loan, and voila´, they are no longer on the mortgage.  I know, you may have already known this and are looking for another option, but generally speaking, there really is no other option.  You could sell the home, and both are off the loan.  I’m sure on very rare occasions, someone called the mortgage servicer and asked to be removed from the loan and somewhere in this world a lender produced some documentation to remove one spouse and keep the loan where it was with all the same terms, but my opinion is, you are wasting your time if you think you are going to find another option other than refinancing a mortgage to remove a person from the loan.

What’s the difference in removing a spouse from the mortgage or home loan vs removing them from title?
